Resumen
El contemplar el control polÃtico dentro del Poder Judicial de la Federación al realizar funciones de Tribunal Constitucional a través de su instancia máxima, la Suprema Corte de Justicia de la Nación, limita su actuación en su papel de protección y salvaguarda de los derechos humanos y garantÃas contenidos en la Constitución y los Tratados Internacionales de los que el
Estado Mexicano es parte, de ahà la sugerencia de su independencia en un Órgano de Control PolÃtico ajeno al Poder Judicial de la Federación en aras de ser un camino viable en la conservación del Estado de Derecho.
Abstract
To contemplate the political control within the Judicial Power of the Federation when performing functions of the Constitutional Court through its highest instance, the Supreme Court of Justice of the Nation, limits its action in its role of protection and safeguard of the human rights and guarantees
contained in the Constitution and the International Treaties of those that the Mexican State is part of, hence the suggestion of its independence in an Entity of Political Control outside the Judicial Power of the Federation in
order to be a viable path in the conservation of the Rule of Law.
