Resumen
En el presente artÃculo, a partir de un esbozo histórico se enuncian algunos de los motivos que animaron al Congreso Constituyente de 1916 para la elaboración de la Constitución
PolÃtica de los Estados Unidos Mexicanos, su sentido social y en especial los artÃculos que aluden la explotación petrolera. Además, cómo fue el escenario internacional donde el preciado
fluido refrendó su importancia estratégica y adquirió omnipresencia, tanto en su modalidad de energético como materia prima esencial en las sociedades contemporáneas. Finalmente,
cómo a partir de la segunda mitad del siglo XX, a consecuencia del descubrimiento de la versatilidad de sus usos múltiples, también crecieron los intereses en torno del hidrocarburo en
el mercado internacional. De ahà los riesgos de la Reforma Energética; tanto por su inconstitucionalidad, como la de exponer a la empresa en su totalidad –en la cual descansa la
economÃa nacional– de ser el aval de una deuda impagable.

Abstract
This article approaches the responsibility that the Political Constitucion of Mexico imposes to the State, in regards to the exploration, exploitation, and oil industrial process, taking into account an important part of the latter. In a very brief period of time, the constituent assembly that developed the precepts which belong to the oil matter. Could ratify their concerns as the strategic importance of the Hydrocarbons increased disproportionately among the international
scene. On the other hand, and at the same time, the international oil companies showed their economic and political capacity to act against those who hindered or obstructed their operations. Thus, the recently proposed Energetic Reform ignores the risks taken in the past and it is unconstitutional. Likewise, in case that private investment in Petroleos Mexicanos is allowed, the oil institution could remain as a guarantee of an unpayable debt, not withstanding the national economy rests upon it.
